If I’m reading between the lines. Jack Smiths confidence in this case going forward is glaring me right in the face. It seems to me he seems confident that Trump will stand trial. That’s good news for Democracy and the rule of law.

Judge Merchan's decision to delay sentencing denied Trump the ability to fabricate another grifting circus. Trump wanted to be sentenced. He wanted to play the martyr and cry, shout and whine about being a victim. Not going to work this time!

The integrity of the case as it moves toward trial is the most important aspect, the arguement on ability to seat an impartial jury if too too much is revealed could be used by the defense, we've already been shown the lack of impartiality by SCOTUS in their recent rulings. I do wonder how Justice ACB feels about the GOP candidates putting targets on two of her children, who are Haitian, one would think she would speak out in their defense. Vote 💙

I cannot help but be deeply impressed with how Jack Smith is handling the Supremes' nakedly-partisan and wrong ruling—by making CERTAIN everything he accuses Trump and his minions of cannot reasonably be argued to be remotely within the duties of the President, so when he finally gets to take his case to trial Trump's lawyers won't have a legal leg to stand on, and Donald Trump will be nothing but a rightless felon awaiting The State's harsh justice.

Was it remotely reasonable for the SC to rule corporations have free speech rights equal to citizens, or that the 2A’s reference to militias was gratuitous, or that presidents are granted immunity by the Constitution? Do not assume that our definition of what is reasonable or textual will survive the scrutiny of this partisan test…”is it good for the Heritage Foundation?”

Trump v. US will go down in history as one of SCOTUS's worst decisions. And there have been some doosies in the 235 years they've been around. Think of this as John Robert's Dred Scott. It will be remembered and reviled.

Good arguments. The Extremes seemed to have basically waffled with its set up of "core immunity," "qualified immunity," and private action with no immunity. But the superseding indictment seems to fit into this scheme pretty well.

The immunity decision seems to have set up Chutkan as a trier of fact on issues like "acting like a candidate" vs "acting as a president." Do you think that if she goes with that, the resulting appeal will overlook the "trier of fact" role and just decide he was in all of this acting as president? If so, so much for the whole structure of the roles of trial vs appellate court.

Couldn't/wouldn't defense just argue that he was still president at the time, since if there were any national security emergency, donOLD would STILL be the one in charge?
