Excuse Me?
The media is going nuts over Merrick Garland advising President Biden that the audio recording of the interview between him and Special Counsel Hur is subject to Executive Privilege. Unbelievable.
As I watch the continued cross examination of Michael Cohen - which is going poorly for Team Trump - and which they’re doing in front of Trump’s douchey Freedom Caucus entourage - I’m seeing headlines about Merrick Garland and the DoJ determining that the audio interview between Biden and Hur is covered by executive privilege. They say the “GOP will clobber him for covering up evidence of his aging.”
Excuse me?
What’s missing from most of the stories on this is how Trump tried to wield Executive Privilege multiple times during January 6th investigations by both the January 6th Committee and Special Counsel Jack Smith.
I see NO mention of what McCabe and I refer to as the “Ocha Nostra” - eight, count em’ EIGHT witnesses that asserted executive privilege to try and weasel their way out of testifying against Trump. They include Mark Meadows, Ken Cuccinelli, Dan Scavino, Nick Luna, Johnny McEntee, Miller, O’Brien, and Ratcliffe. They all delayed the January 6th investigation for a year in a prolonged Executive Privilege battle - and they all eventually LOST because the privilege doesn’t cover their testimony. What about them?
Or what about Mike Pence? A guy who was literally almost murdered by Trump and the insurrectionists - who tried to assert Speech or Debate Privilege to avoid telling the truth to a grand jury. He also lost *most* of his case and eventually had to testify. But not before causing another significant delay in the January 6th indictment. No mention of that.
Or what about John Eastman trying Executive Privilege, Attorney Client Privilege, Work Product Privilege and Deliberative Process Privilege on for size so HE could avoid handing over his emails to the Committee? He ended up losing because crimes aren’t covered by Privilege. Yet another massive delay in that investigation.
Or how about when Trump sued to block documents being handed over to the Committee citing Executive Privilege and eventually losing at the Supreme Court? No mention of that, either.
Regarding the audio recording of Biden and Hur - there’s no crime here. And Biden is *actually* the president and *actually* HAS executive privilege. Not to mention the fact that we have the full transcript of the interview. This is an appropriate use of the Privilege from a man who is NOT under federal criminal investigation and has been exonerated - not like Trump claims to have been exonerated by the Mueller report - but actual exoneration.
Besides, the GOP only wants this audio so they can cherry pick it and damage national security all in the name of holding on to what little power they have for as long as they can. They can go fuck themselves.
Keep all this in mind when you read articles about this, and when the GOP cries in their gestapo soup about Privilege. I don’t wanna hear it.
